LexiLex User Agreement

1. Introduction

1.1. This User Agreement ("Agreement") governs the relationship between ILYA KHARYN ("Developer"), residing in Poland, and users of the LexiLex mobile application ("Application").

1.2. LexiLex is an educational tool for language learning, text translation, and analysis, using visual tools like flashcards. It is developed under the unregistered trademark Qellum.

1.3. Using the Application means you fully agree with this Agreement. If you do not agree, do not use the Application.

2. Account and Registration

2.1. The Application is for users aged 16 and older. Users under 16 are not permitted to use the Application.

2.2. To use the Application, create an account via:

• Email and password
• Google account
• Apple ID

2.3. You must provide accurate registration information and are responsible for securing your account credentials.

2.4. One account per user is allowed.

3. Permitted and Prohibited Uses

3.1. Permitted Uses:

• Enter texts via keyboard, microphone, camera, or image selection for personal study.
• Translate and analyze texts, study phrases via flashcards, and vocalize phrases.
• Use all features for non-commercial, educational purposes.

3.2. Prohibited Actions:

• Using the Application for illegal or commercial purposes.
• Entering content promoting violence, hate speech, illegal activities, adult content, or violating third-party copyrights or privacy.
• Attempting to hack, bypass security, use bots, overload servers, or reverse-engineer the Application.
• Transferring account access to others.

3.3. User content is private and accessible only to its creator.

4. Functionality and Limitations

4.1. The Application offers:

• Text input via keyboard, microphone (speech-to-text), camera, and image selection.
• Speech and image recognition via Google Cloud API.
• Text translation and analysis via Claude API and OpenAI API.
• Phrase vocalization via Google Text-to-Speech.
• Flashcard-based learning system.
• Data export and deletion options.

4.2. Limitations:

• Requires an internet connection; no offline mode available.
• Translations and analyses are provided "as is" without guaranteed accuracy, especially for specialized texts.
• Verify important translations with professional translators.
• The Developer is not liable for decisions based on translations or analyses.
• Speech recognition and OCR accuracy may vary depending on audio quality and image clarity.

4.3. Fair Usage:

• The Application is designed for personal educational use.
• Excessive automated usage may result in temporary restrictions to ensure service availability for all users.
• Usage limits depend on system capabilities and third-party service constraints, and may be adjusted dynamically without prior notice to maintain optimal performance for all users.

5. Intellectual Property

5.1. The Developer owns all rights to the Application.

5.2. You retain rights to your created content but grant the Developer a limited, non-exclusive license to process it for translation, analysis, speech recognition, OCR, and vocalization purposes.

5.3. You are responsible for ensuring your content respects others' copyrights.

6. Monetization

6.1. The Application is free during its beta phase.

6.2. Future monetization may include advertisements or paid subscriptions. Users will be notified at least 30 days in advance and prompted to consent before implementation.

7. Technical Support and Updates

7.1. Support:

• Issues: technical problems, functionality questions, account recovery.
• Response time: up to 48 hours on business days.

7.2. Updates:

• Automatic updates improve functionality and security.
• Critical security updates are mandatory.
• Non-critical updates are optional but may affect feature access.
• Major updates may require agreeing to revised terms.

8. Termination

8.1. By User:

• Delete your account via settings, automatically removing all data from our servers.

8.2. By Developer:

• Accounts violating this Agreement may be blocked. Appeals can be made within 14 days via lexilex.qellum@gmail.com.
• Service termination requires 30 days' notice, with data export provided and permanent data deletion afterward.

9. Limitation of Liability

9.1. The Application is provided "as is" without warranties.

9.2. The Developer is not liable for:

• Translation or analysis inaccuracies from AI services.
• Speech recognition or OCR errors.
• Temporary service unavailability.
• Data loss due to technical issues.
• Direct or indirect damages from using the Application.
• Service interruptions due to force majeure (e.g., natural disasters, cyberattacks).
• Third-party API service limitations or outages (Google Cloud, Claude, OpenAI).

10. Applicable Law and Disputes

10.1. This Agreement is governed by Polish law. Where required, local laws may provide additional rights.

10.2. Disputes are resolved in Polish courts.

10.3. The English version of this Agreement prevails. Translated versions are for convenience only.

11. Accessibility

11.1. The Application aims to be accessible to all users, including those with disabilities. Contact lexilex.qellum@gmail.com for support.

12. Changes to the Agreement

12.1. The Developer may update this Agreement, notifying users via in-app messages or email.

12.2. Significant changes take effect 30 days after notification. Continued use implies agreement.
